RENTER agrees to rent Mullet Republic “Blue Abaco”, a privately owned home, for a period shown above beginning at 4:00 pm EST and ending at 11:00 am EST on the dates listed above. RESERVATIONS:  This reservation will be pending receipt of the following: a) A fully executed Signed Rental Contract b) $250 deposit Secured by credit card.  These items must be received prior to issuing a reservation and should be faxed for the quickest booking confirmation or snail mailed (please allow 7 days for mailing) to the following address:

PAYMENTS: All rent payments are due in full 30 days in advance of the rental start date; failure to pay the rent will be considered cancellation with less than 30 days notice.  All payments must be made by credit card ONLY (NO CHECKS).  If the Renter’s credit card is declined the reservation will be cancelled and deposits forfeited.

RENTER agrees to pay the posted Weekly Rental Rates for the dates posted above plus applicable State Sales Tax (9%) at least 30 days prior to the arrival date; failure to pay on time will constitute cancellation and be treated as cancellation with less than 30 days notice. The $250 deposit to hold the home converts to the security deposit. Renter understands the rental rates posted is for 1-8 persons for weekly rentals. 2 & 3 nights rentals has a limit of 6 persons.

 

CANCELLATION: If this reservation is canceled the entire deposit will be returned in full up to 60 days before Renter’s scheduled arrival date.  All notice of cancellations must be made to Mullet Republic, LLC by email to yonrealty@aol.com. If less than 60 days notice but more than 30 days, the equivalent of one night rental plus tax will be charged against your payment and the rental agreement will be terminated. If less than 30 days notice before rental start date the rental payments/deposits will be refunded less 25% charge of the total rental amount for cancellation and only if the unit re-rents with no time or revenue lost, otherwise the entire rental payment excluding security deposit will be forfeited by RENTER. If the RENTER does not show up or leaves early, the RENTER is responsible for the balance of rent for the full term of the contract unless the house is rented. If official hurricane warnings or evacuation orders are issued the RENTER may be released from this contract, the rent will be prorated, and assuming other conditions of this contract are met the deposit and rent balance will be returned to the RENTER.  This will depend on the specific circumstances of the hurricane.  Owner reserves the right to cancel this agreement in the event of an emergency or unforeseen event.

SECURITY DEPOSIT will be held until the inspection of the property, between 5 and 7 days to ensure that the house and grounds are left in the same condition and order as you found it on your date of arrival. RENTER assures OWNER that any tenant who violates any of the terms of this contract shall be immediately denied occupancy and shall remedy any damages or other expenses which are caused by the tenant and/or the tenant's guest(s).The RENTER assumes full responsibility for missing items and damage to the property, as well as any excessive cleaning costs, and any other damages resulting from Renter’s or other occupant’s failure to comply with this contract.  These damages/charges will be deducted from the deposit, if damages/charges exceed the deposit amount the credit card on file will charged to cover additional damages/charges, the RENTER will be responsible for all those costs as well as any costs associated with collection of those damages/charges or defending claims of damages.  Unless RENTER specifies otherwise deposit will be returned by check or Credit Card if payments were made by credit card the issuing card will be credited back.

MAXIMUM NUMBER OF OCCUPANTS: Failure to comply will result in forfeiture of deposit and additional expenses. The house or premises is not to be occupied by more than eight (8) persons at any one time this includes guest or visitors. Violation of the maximum occupancy provision can result in serious health problems directly related to overuse of the premises and may cause owner damage due to deterioration of the property and contents which is difficult to quantify. Therefore, in the event RENTER allows the premises to be occupied by more than 8 persons, RENTER will be immediately evicted. RENTER will also be responsible to pay owner the sum of one hundred and fifty ($150.00) dollars per person in excess of eight person maximum or as entered above per day the RENTER allows the premises to be occupied by no more than 8 persons. Violation of this provision subjects RENTER to significant penalties which are necessary to protect the OWNER because of the fact that this contract is a short term vacation rental.  

NOT ALLOWED: Loud parties or gatherings of more than 8 persons at any one time on the property other disturbances are not allowed.  No illegal substances are allowed on the property.  Violation of the ban on loud parties or illegal substances will be grounds for owner or owner’s agent to require RENTER to immediately leave the house and forfeit any rent or security deposit.  Hookup or occupation of any motor home or camper is not allowed. Maximum number of vehicles allowed on premises is 4 passenger vehicles and 1 boat & trailer.  NO ATV’s or Golf carts or unlicensed motorized vehicles.  At no time park any vehicles on the grass/yard please use the driveway only to avoid damages to the yard and irrigation system.

OTHER CONDITIONS:

A set of house rules are attached, by signing this contract the RENTER agrees to observe these rules and is responsible that other tenants and guests also follows the rules.

 

The owner and/or owner’s agent shall have the right of access to the property at any reasonable time for inspections, maintenance, or repairs. In an emergency and/or a violation of this rental agreement the OWNER or his/her agent may enter the premises at any time without securing prior permission from RENTER. The RENTER and owner agree that this is rental is regulated under Florida Statutes governing Lodging establishments (Chapter 509) and that the RENTER is a guest as defined in those statutes. This rental agreement is a part of the special contract between the operator and guest as defined in the statues. The owner and his agent are the operator as defined in the statues.  The house is offered as a Resort Dwelling for short-term rental not subject to the Florida Landlord Tenant Statutes.

If  RENTER abandons or vacates the premises, OWNER may at his option terminate this Contract, enter the premises, and remove all property.

RENTER may not let, sublet or assign this Contract for all or any part of the premises.

RENTER assumes full responsibility for fulfilling the terms of the Contract for the period stated and assure the OWNER full recourse for the payment of any amount outstanding from the total amount due in accord with the terms as stated above including any outstanding or unpaid charges that are the responsibility of the RENTER.

Please return keys as instructed on written information sent to you prior to your arrival. If keys are not returned per instructions, a new lock will be installed and the cost will be taken out of the deposit. Keys are not to be duplicated.

 

NO PETS ARE ALLOWED renter agrees to have no pets on the property at any time. Failure to comply will result in forfeiture of deposit and additional expenses.

NO SMOKING IS ALLOWED INSIDE OF HOME Failure to comply will result in forfeiture of deposit and additional expenses.

RENTER shall make available to OWNER or their agent for the premises of entering to make necessary or convenient repairs.

RENTER agrees that he/she shall not paint or make alterations to the property, including changing existing locks or adding new ones, without the OWNER'S written consent.

RENTER agrees to indemnify and hold OWNER harmless from all liability, loss or damage arising from any nuisance or harm made or suffered on the premises by the RENTER, tenants, or guests or from any carelessness, neglect, or improper conduct of any persons entering, occupying or visiting the premises.

In the event that any action shall be commenced by either party arising out of, or concerning this contract or any right or obligation derived there from, the prevailing party shall be entitled to receive attorney's fees as fixed by the Court in addition to all relief at law or equity.

Either party may terminate this Contract in the event of a violation of any provision of this Contract by the other party in the manner and as provided by law. 

THE FOLLOWING ARE THE HOUSE RULES AND TERMS DURING YOUR STAY

 

CHECK IN/OUT - Check in 4:00 PM EST, Check out by 11:00 AM EST , There is NO late check outs allowed. NO EXCEPTIONS anyone found to be on the premises or the property after 11:15 AM EST will be accessed a late departure fee of $150.00 charged to your account. Please respect other families arriving after you expect it clean and ready just as you did.

CLEAN OUT FEE: In an effort to help reduce your rental cost and avoid a clean out fee upon your departure, please leave the property in the same condition and order as you found it on your date of arrival.  If you wish to have us to do the clean out, an additional clean out fee of  $100.00 will charged to your account unless excessive cleaning is required then the fee is based on actual cleaning times and expenses.  If you decide to have us do the clean out on departure, we will be HAPPY to accommodate and let you enjoy your vacation.

 

NO SMOKING / NO PETS is allowed in the house—UNDER ANY CIRCUMSTANCES. Please smoke outside, but do not throw butts on the ground or on the deck. NO PETS are allowed in the house or on the property. Failure to comply will result in forfeiture of deposit and additional expenses.  

ANY PROBLEMS - If anything goes wrong, please call, please call the individual listed on the telephone first. This person lives in the immediate area and will normally be available to make sure everything is okay. The owner can usually be reached at these local numbers (850) 570-2245 cell or (850) 294-7827 cell.

INTERNET ACCESS: High speed Internet access is offered for free and cannot be guaranteed or warranted with this rental. The Wifi wireless access requires (Passphrase) a site code which is: 5dad1bdeaf

COOKING FISH: Please DO NOT FRY FISH INSIDE THE HOUSE, for the same reason most of us don’t do it our own homes the smell lingers for several days afterwards, something I’m sure you don’t want to be exposed to upon your arrival to our rental unit. Use the BBQ grill provided outside.  Please remember to bring your fish skillet for best results.

PLUMBING PROBLEMS – If you have plumbing problems, call the designated person on the telephone. DO NOT USE LIQUID PLUMBER OR THESE TYPES OF PRODUCTS. Prevent problems by not flushing sanitary products in the toilet and by wiping plates of food in the trash before washing in the sink. A plunger is available if needed. SEPTIC SYSTEM – Please remember that anything that goes down the drain goes right into the ground and is absorbed into the environment.

WINDOWS AND DOORS – Always lock windows and doors when you leave. Sudden windy rains do occur and water can get into the house if not securely closed.

COUNTER – The counter is not meant for sitting – by children or adults-- and will not support the weight. If you sit on it and break it, you will be charged for the repairs.

TURTLES - Turtles nest on the beach May through October. Lights disturb nesting turtles so PLEASE DO NOT LEAVE LIGHTS ON OUTSIDE, ON THE BALCONY OR IN ANY ROOM FACING THE GULF. The lights disorient the turtles that lay eggs at night. If the eggs hatch at night, the newborn turtles might go the wrong way, which could kill the entire group of baby turtles. Leaving lights on is illegal—Florida protects its natural habitat. You can get fined up to $500 for leaving lights on! It is illegal to capture or handle the turtles or their eggs or nest area at any time.

Fires on the beach are banned by county ordinance. Fires on the beach are absolutely prohibited during turtle, season May to October. Fires may also disorient the turtles.  

BBQ - A BBQ was placed outside on the patio. Please keep it away from adjacent wall or vinyl siding of the home. 

LOUNGE CHAIRS – If not using the chairs, please lay them flat and stack them in the west corner of the deck – where you found them when you arrived.  

LINENS - We do not provide linen service. You can, however, use our private sheets, pillows, and blankets. You are welcome to use them. We ask that you wash, dry, and fold the linen before you leave, and place them on the bed where you found them when you arrived. A charge of $35 will be added if linens are not left per above. Please do not take sheets, towels or other items to the beach or outside the home. PLEASE DO NOT TAKE TOWELS TO THE BEACH.

GARBAGE COLLECTION:  All trash and garage must be placed in the garbage collection containers provided and taken to the street Tuesday evening for collection on Wednesday mornings by 7:00 AM. Failure to meet the garbage collection times will result in a collection fee of $30.00 charged to your account.

DISHES – Dishware, glassware, kitchenware and/or utensils have been provided in the home as a guest convenience. These materials have not been sanitized.

TELEPHONE - You can receive calls and make local calls toll free.  You will need a calling card or credit card to make long distance or toll calls. You can call 800 numbers but not 900 numbers. You can receive calls. The phone number at the house is (850) 349-2311. 

DISTURBANCES - No loud or destructive parties are allowed. People come here for peace and quiet. Should you violate this, you will be evicted. Illegal drugs of any kind are not allowed at any time. The house or property is not to be occupied by more than eight (8) persons at any one time this includes guest or visitors.

FURNITURE: Moving furniture is not suggested, but if you wish to do so, please lift the furniture off the ground.

WASHER/DRYER – The washer and dryer is meant as a convenience during your stay. Please remember that the home uses a septic system. Do not overfill with clothes. Check lint drawer on dryer. Throw lint in trash, not sink.

GROUNDS FOR EXPULSION: Violation of house rules are grounds for immediate expulsion and loss of all rent and deposits. Other reasons for expulsion include: breaking terms of the contract, more people staying in the house than contracted for; disturbing the neighbors; unauthorized pets; keeping the house excessively dirty; negligence, property damage or other reasonable reasons. Your deposit and rent will be forfeited as stated in the contract.

 TAKING THINGS TO THE BEACH – Please do not take house items to the beach with the exception of beach chairs.  

BEFORE YOU LEAVE THE HOUSE

 

CLEANING: In an effort to help reduce your rental cost and avoid a clean out fee upon your departure, please leave the property in the same condition and order as you found it on your date of arrival to avoid clean out fee.  If you wish to have us to do the clean out, an additional clean out fee of $100.00 will be charged to your account unless excessive cleaning is required then the fee is based on actual cleaning time and expenses.  If you decide to have us do the clean out on departure, we will be HAPPY to accommodate and let you enjoy your vacation.

FOOD: Do not leave any food or it will be thrown away—this includes food in the refrigerator and freezer.

GARBAGE:  Please take the garbage out every Tuesday evening for Wednesday AM garbage pickup curb side. When you leave and place it in the large bin in front of the house. Don’t leave bags of garbage out overnight as raccoons open the bags and spread the trash. Do not leave trash on the beach or around the home.

RECYCLING: There is a recycle station located down the street on Bald Point Road on your way to town. It has one bin for cans (aluminum and tin), one for paper, and one for plastic. 

OUTDOOR ITEMS: Make sure all outside items are secure so they won’t be blown into the house. Do not leave any loose trash, bottles outside or items that can be propelled on a windy day.

LOUNGE CHAIRS: Lay them flat and stack them in the west corner of the deck – where you found them when you arrived.

WINDOWS AND DOOR: Close and lock all windows and doors when you leave.

LIGHT: Turn off all lights including lights outside.

AIR CONDITIONER/HEATER: Turn off the air conditioner/heater (center position, top control). Controls are located in the hallway near the master bedroom

LINENS and TOWELS: If you used our private linen, please wash, dry, and fold the linen before you leave and place them on the bed or bath they correspond to. Failure to wash ALL the linen used as prescribed will result in a $35.00 charge against your security deposit.  We hope you understand were offering you the option to reduce your vacation rental cost as opposed to charging a clean out fee in addition to each weekly rental.

DEPOSIT: We truly hope we will never have to keep your deposit. Please follow these rules as well as the contract so that we will not be force to keep any part of your deposit.  

 

Both parties agree to the use of electronic communications in the place of written communications, and to accept electronic communications as binding.
